Benjamin Ockner's practice focuses primarily on zoning, land use, and real estate litigation, and business litigation. He has been instrumental in obtaining successful outcomes in several major zoning and land use cases in the Ohio Supreme Court, including Goldberg Companies, Inc. v. Council of the City of Richmond Heights (1998), 81 Ohio St.3d 207, 690 N.E.2d 510, which returned Ohio to the Village of Euclid v. Ambler Realty Co. standard for determining the constitutional validity of zoning ordinances; State ex rel. Shemo v. Mayfield Heights (2002), 95 Ohio St.3d 59, which established the right in Ohio for the recovery by a property owner from a municipality of the diminution in value of property during the time a municipality has enforced an unconstitutional regulation against the property; and State ex rel. Commt. for the Referendum of Ord. No. 3844-02 v. Norris, 99 Ohio St.3d 336, 2003-Ohio-3887, which overruled the Court's decision in State ex rel. Crossman Communities of Ohio, Inc. v. Greene Cty. Bd. of Elections (1999), 87 Ohio St.3d 132, 717 N.E.2d 1091. Other recent decisions in the Ohio Supreme Court in which Mr. Ockner was involved include State ex rel. Webb v. Bliss, 99 Ohio St. 3d 166, 2003-Ohio-3049; State, ex rel. Shemo v. Mayfield Heights (2000), 93 Ohio St.3d 1, 752 N.E.2d 854; Shemo v. Mayfield Heights (2000), 88 Ohio St.3d 7, 722 N.E.2d 1018; and Jones v. Chagrin Falls (1997), 77 Ohio St. 456, 674 N.E.2d 1388.

Mr. Ockner has represented numerous local and national property owners and developers regarding zoning and land use issues throughout Ohio. He has represented several national telecommunications companies in the deployment of their networks in Ohio. Mr. Ockner has written and lectured extensively on zoning and land use issues.

Mr. Ockner's business litigation practice includes unfair competition, trade secret, landlord-tenant and commercial matters. Mr. Ockner was a founding member of the Business Litigation Committee of the Cleveland Bar Associations' Litigation Section, and he has served as the Program Chairman for the Civil Litigation portion of the Cleveland Bar Association's Practice and Procedure Clinic.

In addition to the State of Ohio, Mr. Ockner is admitted to practice before the United States Court of Appeals for the Sixth Circuit, the United States Tax Court, the United States District Court for the Northern District of Ohio, the United States District Court for the Southern District of Ohio, and the United States District Court for the District of Colorado.

Mr. Ockner belongs to the Cleveland, Ohio State and American Bar Associations.
